Release & Waiver of Liability

This Release and Waiver of Liability (the “Release”) is executed as of the application date by the applicant (the “Grant Recipient”) or the parent or legal guardian of the Grant Recipient, in favor of PSFCA Big 33, a Pennsylvania nonprofit corporation and its directors, officers, employees, and agents. The Grant Recipient has applied for a grant from PSFCA Big 33 to engage in activities funded through an award by PSFCA Big 33 (the “Activities”). The Grand Recipient understand that the Activities may include physical activities, exposure to hazardous conditions and other circumstances that may result in personal injuries.

The Grant Recipient hereby freely, voluntarily and without duress Releases PSFCA Big 33 under the following terms:

  1. Release and Waiver: By acknowledging this Release and Waiver where indicated in the application, Grant Recipient does hereby release and forever discharge and hold harmless PSFCA Big 33 and its successors and assigns for any and all liability, claims, and demands of whatever kind of nature, either in law or in equity, that arise or may hereafter arise from Grant Recipient’s Activities with a vendor or service provider funded through a grant by PSFCA Big 33.
    GRANT RECIPIENT UNDERSTANDS THAT THIS RELEASE DISCHARGES PSFCA BIG 33 FROM ANY LIABILITY OR CLAIM THAT THE GRANT RECIPIENT MAY HAVE AGAINST PSFCA BIG 33 WITH RESPECT TO ANY BODILY INJURY, PERSONAL INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE THAT MAY RESULT FROM GRANT RECIPIENT’S ACTIVITIES FUNDED THROUGH A GRANT BY PSFCA BIG 33, WHETHER CAUSED BY THE NEGLIGENCE OR WILLFUL CONDUCT OF PSFCA BIG 33 OR ITS OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS OR OTHERWISE. GRANT RECIPIENT ALSO UNDERSTANDS THAT PSFCA BIG 33 DOES NOT ASSUME ANY RESPONSIBILITY FOR OR OBLIGATION TO PROVIDE FINANCIAL ASSISTANCE OR OTHER ASSISTANCE INCLUDING BUT NOT LIMITED TO MEDICAL, HEALTH, OR DISABILITY INSURANCE IN THE EVENT OF INJURY OR ILLNESS.
  2. Medical Treatment: By acknowledging this Release and Waiver where indicated in the application, Grant Recipient does hereby release and forever discharge PSFCA Big 33 from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with the Grant Recipient’s Activities funded by a grant from PSFCA Big 33.
  3. Assumption of the Risk: Grant Recipient understands that the Activities may involve work that may be hazardous to the Grant Recipient, including, but not limited to, physical activities, exposure to hazardous conditions, or other circumstances that may result in personal injuries, and transportation to and from the Activities’ sites. By acknowledging this Release and Waiver where indicated in the application, Grant Recipient hereby expressly and specifically assumes the risk of injury or harm in the Activities and releases PSFCA Big 33 from all liability for injury, illness, death, or property damage resulting from the Activities.
  4. Insurance: Grant Recipient understands that PSFCA Big 33 does not carry or maintain health, medical, or disability insurance coverage for any grant recipient. Each Grant Recipient is expected and encouraged to obtain his or her own medical or health insurance coverage.
  5. Governing Law; Validity: By acknowledging this Release and Waiver where indicated in the application, Grant Recipient expressly agrees that this Release is entitled to be as broad and inclusive as permitted by the laws of the Commonwealth of Pennsylvania and that this Release shall be governed by and interpreted in accordance with the laws of the Commonwealth of Pennsylvania. Grant Recipient also agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this release, which shall continue to be enforceable.
  6. Grant Recipient Age: If the Grant Recipient is younger than 18 years old, then the person acknowledging this Release and Waiver where indicated in the application hereby certifies that he or she is the parent or legal guardian of the Grant Recipient and does hereby give this Release and Waiver without reservation on behalf of the Applicant. If Grant Recipient is over 18 years old, the Grant Recipient and Parent/Guardian should both sign on behalf of the Applicant.
